Terms of Service & Rental Agreement

Welcome to Haul-A-Way Dumpster Rentals. By booking a dumpster rental, paying an invoice, or utilizing our services, you (the "Customer") agree to be legally bound by the following Terms of Service.

1. Rental Charges & Payment Schedule

  • Base Rental Fees: Rental fees cover the initial specified package pricing, standard rental days, and included tonnage weight limits as designated at the time of order booking. Additional rental days are billed at an extra daily rate.

  • Payment Due: Full payment for the dumpster rental is due on or before the dumpster is delivered to the service property.

  • Credit Card & Processing Fees: Credit card payments may carry a convenience fee not greater than 3.54%, and American Express payments may carry a processing fee of up to 5%.

2. Credit Card on File & Overage Authorizations

  • Card on File Policy: The credit card provided at checkout will be securely tokenized and kept on file for all potential secondary charges related to the rental period. The Customer remains fully responsible for any pending charges that are unable to be successfully billed to the card on file.

  • Weight Limits & Tonnage Overages: Each dumpster size carries a specific tonnage weight limit. Any extra weight exceeding the limit will be automatically billed as an overage fee following verification at the corresponding landfill scale.

  • Overfilling & Debris Heights: Dumpsters must not be filled above the top rim. Overfilled dumpsters pose a major road safety risk and may incur immediate additional sorting or adjustments charges.

  • Non-Payment Consequences: If a customer fails or is unable to pay for their dumpster rental or overage balances, they will be held liable for up to three times the total cost of the dumpster or the maximum penalty allowed under Florida law.

3. Prohibited Materials & Disposal Rules

  • Intended Rental Types: Dumpsters must only be used for their intended rental type (e.g., standard household debris vs. heavy construction debris). Disposing of construction debris inside a designated household rental may incur supplementary disposal charges.

  • Strictly Prohibited Waste Items: The Customer is 100% responsible for all materials placed inside the container. You agree to ensure that absolutely no prohibited materials are disposed of in the dumpster, including but not limited to:

    • Dirt, rocks, sand, sod, and asphalt (unless explicitly pre-approved; asphalt only accepted at half-dumpster capacity max).

    • Refrigerators, tires, chemicals, car batteries, and railroad ties.

    • Toxic materials, hazardous waste, or substances posing safety hazards (e.g., asbestos, sealed tanks/drums, wet paint, oils, and all other liquid chemicals).

  • Violation Fines: The Customer accepts all associated sorting fees, environmental fines, and regulatory assessment charges if any prohibited materials are found upon dumping.

4. Delivery, Access, & Placement Rules

  • Site Placement: Dumpsters will be carefully placed on the driveway or another designated asphalted/solid ground area as specified by the customer.

  • Safe Delivery & Pickup Access: The service property must allow clear, safe, and unobstructed access for our commercial trucks to perform delivery and pickup.

  • Blocking the Container: The dumpster must not be blocked by vehicles, locked gates, or other physical obstacles. Failure to provide clear access or causing a dry-run trip will result in additional charges for rescheduling delivery or pickup.

  • Travel Deposits: Travel deposits are calculated based on the driving distance between the specified service property and the corresponding disposal landfill. Travel deposits are separate and are not deducted from standard package pricing.

  • Non-Removal for Non-Payment: Without full payment clearance, the waste or container will not be hauled from the service property and may incur rolling daily rental costs.

5. Liability, Damage, & Safety Waivers

  • Property & Equipment Damage: The Customer assumes full operational responsibility for any damage caused to our dumpster container during the rental duration. Conversely, Haul-A-Way Dumpster Rentals is not liable for any damage to the surrounding property, driveways, or asphalt during standard placement or removal. We are not responsible for any vehicle damage if personal vehicles are parked too close to the container path during dispatch.

  • Safety Compliance: The Customer agrees to comply with all local, county, state, and federal regulations regarding the disposal of waste materials. For everyone's safety, no individuals should stand near or around the dumpster or truck while it is actively being parked, loaded, or removed. The company is entirely absolved of responsibility for any personal injury or death caused to anyone who stands in the way of or interferes with the moving equipment.

  • Additional Containers: If your dumpster becomes full and you require a swap out or a secondary container, the pricing and legal rules of the new dumpster rental will remain identical to this original agreement unless otherwise updated in writing.
